Welcome to Tatsuhiro Miyazawa (“we”, “us”, “our”). We operate this store to provide customers worldwide with access to original digital sheet music and related services (“Services”). Our store is powered by Shopify.
These Terms of Service (“Terms”) govern your use of the Services.
By accessing or using the Services, you agree to these Terms and our Privacy Policy [LINK].
If you do not agree, you must discontinue use of the Services.
Because our Services are available in multiple countries, mandatory consumer protection laws in your country of residence override any conflicting terms herein.
1. ELIGIBILITY AND ACCOUNT
You must be of legal age in your jurisdiction. You are responsible for any activity conducted through your account. All provided information must be accurate.
2. DIGITAL PRODUCTS
Our products consist of original musical compositions and digital sheet music (PDF files).
Variations in appearance may occur depending on device settings.
Your statutory rights regarding defective or misdescribed digital content (EU/UK/AU/NZ/CA/US) remain unaffected.
3. ORDERS AND DIGITAL DOWNLOADS
Placing an order constitutes an offer to purchase. We may accept or decline any order.
EU/UK Digital Content Directive Notice
Digital products are delivered immediately.
To access downloads, EU/UK customers must:

expressly consent to immediate download, and

acknowledge that the 14-day withdrawal right is lost once download begins.
Without such consent, downloads will be blocked until the withdrawal period expires.
Refunds are handled according to our Refund Policy [LINK].
4. PRICING AND PAYMENTS
Prices may change without notice. Applicable taxes, VAT/GST, or import fees may apply.
You authorize us to charge the payment method you provide.
5. DELIVERY OF DIGITAL PRODUCTS
Digital products are considered delivered once made available for download.
Email or network delays are outside our control, but statutory non-performance rights remain.
6. INTELLECTUAL PROPERTY
All sheet music, musical compositions, audio, text, images, and associated content are owned exclusively by us and protected by copyright.
Purchases grant you a personal, non-transferable license solely for private use.
Redistribution, uploading, file-sharing, resale, or public distribution of the files is prohibited.
7. USE OF DIGITAL SHEET MUSIC (AI TRAINING, PERFORMANCE RIGHTS, DERIVATIVE WORKS)
7.1 Prohibition of AI Training and Automated Data Mining
You may not reproduce, upload, distribute, or provide our sheet music or musical content for:

machine learning or AI model training

dataset creation
-
text and data mining (TDM)
-
automated crawling or data extraction
This prohibition applies to both commercial and non-commercial uses.
For EU/UK residents, this clause constitutes an explicit opt-out under Directive (EU) 2019/790 and the UK Copyright and Related Rights Regulations regarding TDM exceptions.
7.2 Personal (Private) Performance
You may freely perform the purchased sheet music for private, personal, non-public purposes, including practice and private enjoyment within a household.
7.3 Public Performance, Online Posting, and Recordings (Permission Required)
We retain all rights to the musical compositions and sheet music sold in this store.
Thus, the following uses require our prior written permission, regardless of commercial or non-commercial nature:

public performances or live performances at any venue

posting or streaming on YouTube, social media, or video-sharing platforms
-
distributing audio/video recordings to the public
-
any public communication of performances
Please contact us at the email address listed in Section 23 before engaging in such uses.
7.4 Prohibition of Derivative Works (Secondary Creations)
You may not create or distribute derivative works based on our compositions or sheet music, including:

arrangements or adaptations

rewritten melodies or harmonies

new instrumental versions
-
remixes or rearrangements
-
orchestration or re-scoring
-
any other secondary creative works derived from the original
These uses require prior written permission.
Exception: Minor Private Adjustments
Minor changes necessary for personal practice—such as fingering, tempo adjustments, or small octave modifications—are permitted only for private use and may not be shared or published.
8. OPTIONAL TOOLS
Third-party tools are provided “as is” and are used at your own risk.
9. THIRD-PARTY LINKS
We are not responsible for third-party content or websites.
10. RELATIONSHIP WITH SHOPIFY
Shopify hosts our store but is not a party to your transactions and bears no liability.
11. PRIVACY AND DATA TRANSFERS
Personal information is handled in accordance with our Privacy Policy [LINK] and Shopify’s privacy terms.
Your data may be transferred internationally.
EU/UK residents retain all rights under GDPR/UK GDPR.
12. FEEDBACK
Feedback submitted to us may be used for improvement and promotion.

17. LIMITATION OF LIABILITY
Where permitted, our liability is limited to the amount paid for the relevant product.

18. INDEMNIFICATION
You shall indemnify us for damages arising from your breach of these Terms, except where prohibited by law.
19. SEVERABILITY
Unenforceable terms do not affect the remainder.
20. WAIVER AND ENTIRE AGREEMENT
Non-enforcement does not constitute waiver.
These Terms constitute the full agreement.
21. ASSIGNMENT
You may not assign rights without our consent.
We may assign these Terms where permitted by law.
22. GOVERNING LAW AND CONSUMER RIGHTS
Default Rule
These Terms are governed by the laws of Japan.
Consumer Protection Override
If mandatory consumer protection laws in your country provide stronger rights, those rights prevail.
Jurisdiction
Disputes shall be submitted to the Kyoto District Court (Japan),
unless your local laws grant you the right to bring claims before local courts.
23. UPDATES
We may amend these Terms as required.
Continued use constitutes acceptance of updated Terms.
